Alexander Pencu is a member of Meister Seelig & Fein LLP's litigation department where his practice concentrates on complex commercial litigation, products liability and class actions. Mr. Pencu has tried cases in both federal and state courts, as well as before arbitration panels, and has appellate experience before the United States Court of Appeals for both the Second and Ninth Circuits. Mr. Pencu's litigation experience includes breach of contract claims, business torts, unfair trade practices, trade secret misappropriation, shareholder derivative suits, products liability, disputes arising from the sale of businesses and non-compete claims. Mr. Pencu's class action experience includes defending clients against a variety of antitrust claims, consumer protection claims and products liability claims.
Mr. Pencu has represented a wide variety of clients such as: a large publicly-traded chemicals company in litigation against a public European conglomerate for the apportionment of liability arising from a product defect in a widely used pesticide; a publicly traded communications and teledata supplier alleged to have participated in a conspiracy scheme to defraud the U.S. Government on government sponsored capital projects; a public holding company and its senior management involving a suit arising from the sale of a filter manufacturing company to a competitor; a marketing research firm in litigation against former members of its executive staff for misappropriation of confidential information and trade secrets to a primary competitor; several financial advisory firms in litigation surrounding a series of failed deals in which they sustained sizable losses as a result of numerous circumvention schemes; a five-star hotel located overseas and its insurer in an action to recover their losses from a devastating hotel fire which resulted in fatalities, substantial property damage, and business interruption.
Mr. Pencu has presented at seminars for organizations such as WESFACCA, most recently on the topic of "Bulletproofing Your Deals: Lessons from the Litigation Battlefield on Commercial Contract Clauses, US and International." Mr. Pencu has been named a Super Lawyer® Rising Star in the area of Business Litigation for both New England and New York.
Mr. Pencu is admitted to practice in New York and Connecticut, as well as before the United States District Courts for the Southern and Eastern Districts of New York and the District of Connecticut. In addition, Mr. Pencu is admitted to the United States Court of Appeals for the Second and Ninth Circuits.
Mr. Pencu is active in the local, state and national Democratic Party. Prior to joining Meister Seelig & Fein LLP, Mr. Pencu was an attorney with Robinson & Cole LLP and served in the cabinet of former City of Stamford Mayor Dannel P. Malloy's administration. Mr. Pencu graduated from the University of Connecticut School of Law where he was a member of the Law Review and Moot Court Board. He lives in Connecticut with his wife, Rachel, and their daughters Ashley and Elyse.
